Another Success - Bihar DGP Guidelines on Arrest in 498-A

This order is the outcome of the RTI filed by a SIF member to Bihar DGP alongwith the orders of Delhi High Court, Jharkhand High Court, Chennai High Court and Police Circulars of Delhi and Hyderabad.

Here it is:


Prevention of misue of Penal provisions related to crimes against women

It has been observed that in cases related to crime against women, particularly those registered under section 498-A IPC, the in-laws of the victim, those who are of advanced or young age, are also arraigned as accused. Such family members are arrested without proper investigation of the case, vitiating thereby the interest of Justice. The following instructions, therefore, should be complied with to prevent possible misuse of the relevant penal provisions:-

1. The main accused of the criminal case should be arrested only with the approval of the district supreindent of Police, if evidence is, prima facie, available.

2. Investigation regarding the involvement of other accused should proceed expeditiously and if their involvement is confirmed after the supervision by the SP or the concerned SDPO/ DySP, he/ she should be arrested only with the approval of the SP.

3. The concerned SDPO/ DySP should supervise such cases on a priority basis and submit the supervision note within a period of 3 days incorporating a claer opinion on the point of involvement of each accused. SsP should strive to personally supervise sensitive and serious criminal cases involving crimes against women.
